IHC Refers Dr. Aafia Siddiqui Case to a Larger Bench
Islamabad – Justice Inaam Ameen Minhas on Monday took up the petition filed by Dr. Fowzia Siddiqui concerning her sister Dr. Aafia Siddiqui’s health and repatriation from the United States. During the hearing, Dr. Fowzia’s lawyer appeared in court, but Justice Minhas referred the case file to the Chief Justice of the Islamabad High Court, Justice Sardar Muhammad Sarfraz Dogar, noting that the matter would require a larger bench to decide.
The case was only recently transferred to Justice Minhas from Justice Sardar Ejaz Ishaq Khan’s court, following a reshuffle of judges announced by the IHC registrar’s office.
Earlier, Justice Ejaz Ishaq Khan had overseen the case and had issued contempt notices to the Prime Minister and cabinet members for failing to submit a report explaining why the federal government did not assist in Dr. Aafia Siddiqui’s case in a U.S. court, despite directions issued in June.
During that hearing, Justice Ejaz Ishaq warned that if the government did not present the report, he would consider summoning the entire cabinet and initiating contempt proceedings against all members, including the Prime Minister. The court had granted the government additional time to submit the report, cautioning that further delays could invite serious legal consequences.
