Justice Shah Questions Judges Seniority Process

Justice Mansoor Ali Shah has written another letter to the Secretary of the Judicial Commission. In this letter, he raised serious concerns about how the seniority of judges is being decided without proper consultation.

Sources say that Justice Shah wrote this letter before a recent meeting of the Judicial Commission. In the letter, he questioned whether it was legal to decide judges’ seniority without first discussing it with the Chief Justice of Pakistan.

He referred to Article 200 of the Constitution, which says that the President must consult the Chief Justice before making such decisions. Justice Shah said the President made the seniority decision too quickly and without following the correct process.

He also mentioned that this issue is already being discussed in court (an intra-court appeal), so taking any action without waiting for the court’s decision is not appropriate.

It is also important to note that the Judicial Commission of Pakistan (JCP) recently nominated the chief justices of four provincial High Courts. The Supreme Court shared this update in a statement.

According to that statement, the JCP held four meetings, led by Chief Justice Yahya Afridi. In each meeting, most members agreed to let the current acting chief justices continue in their roles.
