Man found guilty of solemnizing his second marriage without the approval of his first wife

A family court in Lahore on Saturday condemned a man to seven months in prison and fined him Rs 500,000 for getting married again without his first wife’s permission.

Judge Adnan Liaqat reiterated in his ruling that “Muhammad Aurangzeb Khan accused is held guilty and convicted for the offence under section 6(5) of the Muslim Family Laws Ordinance 1961.”

Petitioner Zona Nasar claimed in her lawsuit that on September 24, 2011, she wed Aurangzeb Khan. She argued that Khan violated the terms of the Muslim Family Laws Ordinance, 1961 by entering into a second marriage without her consent.

Along with an authenticated copy of the accused’s second marriage certificate, the petitioner also brought her birth certificate, marriage certificate, and the B-Form of their kid to court. She also included witness testimonials.

As part of his defense, the accused said he never concealed his marital status and that he only got married to the second woman with her consent. Khan said that the witnesses for the prosecution had given false testimony against him.

The accused presented a copy of a divorce lawsuit, complaints about the wife alleged misbehavior, and other paperwork to support his allegations.

His attorney contended that the accused entered into the marriage with the verbal consent of his first wife, who knew about it but chose not to register a complaint at the time. He said that despite having granted her consent, the complainant did not call her father or brother as witnesses during the trial. He denied evicting the plaintiff from their home and stated the accused did not hide his prior marriage in the nikahnama of his second marriage.

However, the husband culpability was established, and the court found him guilty after hearing thorough arguments and considering the available evidence.
