IHC Questions Promotion of Officer, Vacant Posts Under Chief Commissioner’s Watch
ISLAMABAD – Justice Mohsin Akhtar Kayani today raised concerns over the promotion of an officer to Labour Inspector and later Labour Officer, after superseding eight senior officials, during a hearing at the Islamabad High Court (IHC).
At the start of proceedings, Justice Kayani questioned why the Chief Commissioner was also serving as the Chairman of the Capital Development Authority (CDA). The judge suggested that the chief commissioner appeared to favor the CDA chair over his primary responsibilities.
He directed the Chief Commissioner to focus on his core duties and investigate why several posts under his jurisdiction remain vacant.
During the hearing, Advocate Riaz Hanif Rahi highlighted that the Chairman of CDA was simultaneously holding the position of Chief Commissioner. Justice Kayani observed that, according to judicial precedents, these roles should be held by separate individuals.
The court noted that despite a significant number of unemployed people, several key positions—including four Labour Inspector posts in Islamabad—remain unfilled. The judge drew a comparison with the patwari system, where duties are often delegated to clerks.
Justice Kayani expressed surprise over the officer’s career progression, saying, “He was first superseded, then promoted after a writ petition was dismissed, and later transferred to a new cadre. If he were such an exceptional officer, he should have been directly appointed Deputy Commissioner.”
The hearing was adjourned until next month, with the court directing the Chief Commissioner to submit a detailed explanation regarding the vacant posts and the officer’s promotion.
