Kashmiris disagree with the ruling
Rejecting the Indian Supreme Court’s decision to uphold the illegal act of the Narendra Modi government to revoke the special status of Indian Illegally Occupied Jammu and Kashmir (IIJOK), Kashmiris from all political persuasions have vowed to persist in their fight for the right to self-determination, as guaranteed by UN Security Council resolutions.
The senior Hurriyat Conference leader Mirwaiz Umar Farooq remarked that while the Indian Supreme Court’s decision on Article 370 was disappointing, it was not shocking.
On X, Mirwaiz Manzil wrote, “The 370 verdict is sad, but not surprising.” People who helped J&K gain entry during the subcontinent’s partition and placed their trust in the guarantees and promises provided by the Indian government must feel profoundly deceived.
“In addition, the state as it was in August 1947 continues to be a bleeding humanitarian and political issue, with the remaining parts of the state divided along the ceasefire line.”
In a statement released in Srinagar in response to the ruling, an All Parties Hurriyat Conference spokesman reportedly stated that the Indian government and its judiciary have no jurisdiction to determine the legal standing of Jammu and Kashmir’s internationally recognized disputed status. According to the spokesman, Kashmiris are fighting for total liberation of Jammu and Kashmir from India’s unlawful occupation, not for Articles 370 or 35A.
Shabbir Ahmed Shah, a senior Hurriyat Conference leader who is incarcerated, has called on the world community to pay attention to the rapidly worsening human rights situation in Indian Illegally Occupied Jammu and Kashmir (IIOJK).
In a message from the notorious Tihar jail in New Delhi, Shabbir Ahmed Shah expressed concern about the world community’s utter silence regarding the appalling conditions in Kashmir and stated that the political, social, cultural, and religious rights of the Kashmiri people are still severely suppressed, according to Kashmir Media Service.
Shah emphasized the need for an early and peaceful resolution of the long-running Kashmir conflict and called on the international community to fulfill its vital role in assisting in a peaceful resolution in line with the widely acknowledged concept of the right to self-determination.
He argued that the people of occupied territory had not been able to experience dignity, liberty, or the full benefits of freedom as guaranteed by the UN charter, the Geneva Convention, and other fundamental international human rights treaties because of India’s persistent refusal to grant the Kashmiris their birthright.
The leader of the APHC claimed that during the course of the previous 76 years, the Indian government has attempted to use its military force to destroy the legitimate struggle of the Kashmiri people for the right to self-determination, rather than demonstrating a sincere desire to grant them their promised right.
India has also stationed a sizable military force in the disputed area. He regretted the extrajudicial executions, detentions, massacres, targeted killings, sieges, torture, enforced disappearances, rape, and molestation carried out by these trigger-happy forces acting under the cover of harsh laws.
According to Shabbir Shah, since August 5, 2019, IIOJK’s residents have been living in hell. The biggest challenge to the conscience of the world was the oppressive conditions under which Kashmiris are compelled to live. He claimed that Kashmir is the only area on Earth where people are denied their human rights.
The head of the APHC pleaded with the world community to recognize Indian state terrorism in IIOJK and to pressure India to settle the outstanding Kashmir conflict in a way that satisfies Kashmiris’ desires for long-lasting peace in the area.
Mushaal Hussein Mullick, Special Assistant to the Prime Minister (SAPM) for Human Rights and Women Empowerment, has stated that India has demonstrated its animosity towards the Kashmiri people by means of the Supreme Court’s ruling.
In a video message, Mushaal Mullick claimed that no one has provided the Kashmiris with justice. She said that the ruling of the Indian Supreme Court went against both UN resolutions and the Geneva Convention.
She claimed that there is a race between Israeli Prime Minister Benjamin Netanyahu and Indian Prime Minister Narendra Modi to see who can carry out the most atrocities. She added that the extent of Indian terrorism and the RSS had reached every corner of the globe, and that the slaughter of Sikhs and Kashmiris was still going on from India into Kashmir.
In a statement made in Srinagar, APHC leader Farida Bahenji stated that the disputed status of Jammu and Kashmir cannot be altered by the Indian Supreme Court’s ruling. She stated that despite numerous UN decisions, Jammu and Kashmir remains a disputed territory that requires resolution. The Modi government’s judgment was upheld by the Indian Supreme Court, demonstrating the court’s prejudice.
Leader of the APHC-AJK Altaf Hussain Wani said that Kashmiris have no faith in the Indian judiciary and said that the Indian government and parliament lack the legal authority to rescind Article 370 because, according to UN Security Council resolutions, Jammu and Kashmir is a disputed territory.
In a statement made in Islamabad, Altaf Ahmad Butt, the leader of the APHC-AJK, referred to the endorsement of Modi’s actions as “just another example of a pliant judiciary,” claiming that it is giving Hindutva ideology precedence over justice, particularly when it comes to cases involving Muslims in India and Indian-occupied Jammu and Kashmir.
Mehbooba Mufti, the president of the People’s Democratic Party, stated in a tweet that the people of Jammu and Kashmir will not give up or lose hope in the wake of the ruling. She declared that they will keep fighting to regain their honor and dignity. She went on to say that they were not done with the Indian Supreme Court’s decision.
Omar Abdullah, Vice President of the National Conference, stated that the fight would go on and that he was not discouraged by the decision. Feeling let down, yet not discouraged. The battle will go on. The BJP needed decades to get to this point. We’re ready for the long haul, too,” he posted on X.
Leader of the Dal Khalsa movement Kanwar Pal Singh has stated that the Indian Supreme Court is not above politics and that the court’s decision to uphold the Indian government’s intention to repeal Article 370 was inevitable.
In response to the Indian Supreme Court’s ruling on the abrogation of Article 370 in Kashmir, Kanwar Pal Singh released a statement in Amritsar. He stated that the Kashmiri people have been denied their rights for a number of decades and that it would have been naive to believe that the high court would reverse the government’s arbitrary decision.
