Supreme Court Acquits Two Men in 2014 Murder Case
In a major ruling, the Supreme Court of Pakistan has overturned the convictions of Sikandar Lashari and Irfan, also known as Faheem, who had previously been sentenced to death. The decision was announced through a brief order by Justice Athar Minallah, with a detailed judgment expected to follow.
The case stems from the 2014 killing of Hunain Tariq, son of Justice Khalid Shahani, in Sindh. Both the trial court and the Sindh High Court had earlier convicted the accused, but the apex court has now cleared them of all charges.
In a separate landmark decision, the Supreme Court also acquitted a man who had spent 12 years in prison after being convicted of sexually assaulting his daughter. The Lahore High Court had upheld his life sentence, but the top court overturned it, citing inconsistencies and doubts about the reliability of the victim’s testimony.
The court emphasized that under the Qanun-e-Shahadat (Law of Evidence), a child’s testimony can only be accepted if the judge is satisfied with the child’s understanding and mental maturity. The ruling noted contradictions in the victim’s statements and inconsistencies in medical evidence, including conflicting observations from the doctor involved.
The Supreme Court has ordered the immediate release of the accused in both cases, provided they are not involved in any other legal matters.
