IHC Reinstates PTA Chairman Hafeez-ur-Rehman

Islamabad: The Islamabad High Court (IHC) on Thursday reinstated Major General (R) Hafeez-ur-Rehman as Chairman of the Pakistan Telecommunication Authority (PTA),   reported.

The PTA chief had approached the court seeking to overturn a single-bench decision that had declared his appointment illegal and requested a stay on the earlier order until the final verdict on his appeal.

A division bench, headed by Justice Muhammad Asif and Justice Inam Amin Minhas, heard the case. PTA Chairman’s lawyer, Qasim Wadood, told the court that the writ petition challenging his client’s appointment was based on the claim that Hafeez-ur-Rehman could not legally be appointed as a PTA member and that the post had been advertised incorrectly.

Wadood argued that the rules governing the appointment had already been amended with cabinet approval before the petition was filed. He added that these changes were officially made on March 25, before the submission of the petition.

After hearing both sides, the court restored Hafeez-ur-Rehman to his post.

The reinstatement comes a day after Justice Babar Sattar of a single bench had accepted a petition against Hafeez-ur-Rehman, ordering his immediate removal from the PTA chairmanship. In a detailed 99-page judgment, the court had declared the chairman’s appointment unlawful, citing a “mala fide exercise of power” in creating the post of Member (Administration) and adjusting its qualifications to accommodate him. The earlier order had required Hafeez-ur-Rehman to step down immediately and cease holding any position within the PTA.
