IHC directs administrators to transfer Imran Khan to Adiala prison

Imran's bail request in the cipher case will be considered in open court

Imran Khan, the leader of the Pakistan Tehreek-e-Insaf, was ordered by the Islamabad High Court (IHC) to be transferred to the Adiala prison on Monday because proceedings in a prisoner’s trial who was arrested in Islamabad should take place there.

The court’s decisions were delivered when a petition regarding the prison amenities granted to the PTI chairman was being heard.

Khan is an under-trial prisoner in the cipher case, according to IHC Chief Justice Aamer Farooq, who also stated that all under-trial detainees in Islamabad are housed in the Adiala jail.

He questioned, “Why is a prisoner awaiting trial held in Attock jail instead of Adiala jail?”

The chief justice ruled that the PTI chairman should be moved and said that Khan was being held at the Attock jail due to the suspended Toshakhana case. He asked Additional Attorney General Munawar Iqbal Dogar, “If tomorrow, you transfer [him] to Rahim Yar Khan, would the trial be held there?” He was looking for a comment on the subject.

Khan’s attorney, Advocate Sher Afzal Marwat, asked for a computer for his client to use during the hearing.

It was claimed that the A and C classes had been eliminated in the jail, according to Justice Farooq. Imran Khan has a right to the better class, according to Barrister Salman Safdar, the deposed prime minister’s attorney. “Now there are general and better classes in the jail,” he added.

Prior to the start of Khan’s post-arrest bail hearing in the cipher case, the IHC postponed making a judgment on Special Prosecutor Zulfiqar Naqvi’s request for in-camera sessions.

Only two attorneys were asked to stay in the courtroom earlier because there were more people there owing to the jail facilities lawsuit that would be heard later.

The trial is being conducted in accordance with the Official Secrets Act, according to the prosecutor, Advocate Shah Khawar, who was also present on the premises. Salman Safdar, a barrister, defended Khan.

After analyzing the case file, the court would decide, Justice Farooq said.

It should be emphasized that the former premier and Shah Mahmood Qureshi, the vice chairman of his party, are both being held as suspects in the cipher case.

It cannot be disputed that the Official Secrets Act is being used to conduct the trial. The jail trial in this case has been justified by security considerations, according to Barrister Safdar, who also noted that the court can order unneeded witnesses to leave if it sees suitable.

Following the presentation of Khan’s attorney’s arguments before the court, Shah Khawar indicated he would do the same.

Justice Farooq smiled in response to Advocate Marwat’s comment that the bail request is being watched by the entire country, adding that now that court proceedings will be streamed live, everyone in the world will be able to watch.
